Terms of Service

These Terms of Service govern service requests, scheduling, estimates, diagnostics, repairs, maintenance, vehicle inspections, parts orders, vehicle transportation arrangements, and related services provided by Lubomiroff Performance LLC.

The applicable estimate, invoice, Repair Order, Tech Report, recommendations, and written customer authorization establish the specific work requested or approved for an individual vehicle.

The warranty status and written notes on the applicable Repair Order, together with the Limited Repair Warranty in effect on the repair date, govern warranty coverage.

Estimates are based on the information, symptoms, access, vehicle condition, and testing available at the time they are prepared.

An estimate is not a guarantee that every concealed, intermittent, progressive, or unrelated condition has already been identified.

Lubomiroff Performance LLC will obtain customer authorization before performing work beyond the authorized scope or materially increasing the approved price.

If the customer cannot be reached, work outside the authorized scope may be paused until authorization is received.

Applicable authorization may be provided in writing, electronically, by text message, through an approved estimate or invoice, or by another method reasonably documenting the customer’s approval.

Diagnostic, inspection, service-call, testing, or travel charges may apply and will be disclosed before scheduling or before the additional charge is incurred.

These charges compensate Lubomiroff Performance LLC for travel, inspection, testing, professional time, equipment use, and documented findings, whether or not the customer authorizes a subsequent repair.

Whether a specific diagnostic or service-call charge is applied toward a repair will be stated in the applicable estimate, Repair Order, invoice, or written service communication.

Vehicle disassembly, testing, or repair may reveal additional conditions that were not reasonably visible or confirmable before work began.

Examples include corrosion, seized or damaged fasteners, previous improper repairs, damaged wiring, missing components, unauthorized modifications, concealed collision damage, fluid contamination, internal component damage, or additional failed parts.

When additional work or cost becomes necessary, Lubomiroff Performance LLC may pause the job and provide updated information or an additional estimate for customer authorization.

Special-order, vehicle-specific, VIN-matched, programmed, imported, used, electrical, or supplier-designated non-returnable parts require 100% prepayment before the order is placed.

The parts and amount covered by the prepayment will be identified in writing before payment.

Once the order has been submitted to the supplier, the parts prepayment is non-refundable when the customer cancels the repair, changes the requested work, becomes unavailable, or fails to provide the vehicle for service.

The parts prepayment will be applied toward the final invoice for the authorized repair.

A parts prepayment will be refunded if Lubomiroff Performance LLC does not place the order, the supplier cannot provide the ordered part, or Lubomiroff Performance LLC cancels the repair for reasons not caused by the customer.

If a supplier accepts a return and issues a credit after a customer cancellation, Lubomiroff Performance LLC may refund the net amount actually recovered, less shipping, return freight, restocking charges, processing costs, and other documented non-recoverable expenses.

Repairs involving substantial parts cost, extended labor, reserved shop time, vehicle transportation, or other significant commitments may require a deposit even when the required parts are normally available from the supplier.

The deposit amount, purpose, payment deadline, application toward the final invoice, and any applicable refund terms will be disclosed and agreed to in writing before payment.

Customer-supplied parts and customer-directed repairs are subject to the warranty status and limitations stated on the Repair Order and the Limited Repair Warranty page.

Additional labor, diagnosis, service calls, removal, reinstallation, fluids, materials, programming, transportation, and related work caused by an incorrect, defective, incompatible, incomplete, damaged, counterfeit, or failed customer-supplied part are chargeable.

Lubomiroff Performance LLC may refuse to install a part that appears incorrect, unsafe, damaged, incomplete, unsuitable, counterfeit, or of questionable quality.

The customer must provide lawful, safe, and reasonably accessible working conditions at the vehicle location.

The customer is responsible for obtaining any necessary permission from the property owner, employer, parking facility, apartment management, homeowners association, or other controlling party.

The vehicle must be located on a stable and reasonably level surface with adequate access and without unsafe traffic exposure or unreasonable interference.

Lubomiroff Performance LLC may postpone, relocate, limit, or stop work because of unsafe conditions, insufficient access, severe weather, inadequate lighting, hazardous traffic, property restrictions, or another condition that prevents safe and professional service.

Some repairs require a lift, shop equipment, controlled working conditions, additional disassembly, or extended repair time.

When mobile completion is not safe or practical, Lubomiroff Performance LLC may offer shop service, vehicle pickup, delivery, towing coordination, or another documented arrangement.

Pricing, customer authorization, transportation responsibilities, and applicable conditions will be confirmed before transportation or additional work begins.

An appointment may be canceled or rescheduled without a fee when Lubomiroff Performance LLC receives notice at least 24 hours before the scheduled appointment time.

A $100 late-cancellation or rescheduling fee applies when notice is received less than 24 hours before the scheduled appointment time.

An appointment is considered a no-show when the customer, vehicle, keys, required authorization, or safe access to the vehicle is not available within 15 minutes after the confirmed appointment time.

A $100 no-show fee applies, and the appointment may be canceled.

Only one late-cancellation or no-show fee applies to the affected appointment.

Lubomiroff Performance LLC may waive the fee when exceptional circumstances make enforcement unreasonable.

Payment is due as stated on the applicable estimate, Repair Order, or invoice.

Applicable sales tax will be added when required by law based on the service location and the nature of the transaction.

Payment confirms receipt of the invoice and the services described on it.

Payment does not waive any warranty right, statutory right, or legal remedy that cannot legally be waived.

The customer should promptly contact Lubomiroff Performance LLC if the invoice or completed work appears inconsistent with the authorized scope.

Warranty coverage is determined by the warranty status and written notes on the applicable Repair Order and by the Lubomiroff Performance LLC Limited Repair Warranty in effect on the repair completion date.

The Warranty page governs workmanship coverage, parts claims, customer-supplied parts, customer-directed repairs, warranty exclusions, available remedies, and warranty-request procedures.

Nothing in these Terms excludes, restricts, or modifies any right, remedy, implied warranty, or obligation that cannot legally be waived or limited.

No employee, technician, contractor, or representative is authorized to modify these Terms unless the modification is confirmed in writing by an authorized representative of Lubomiroff Performance LLC.

If any provision is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

The version in effect on the applicable service date governs that transaction unless a different written agreement applies.
